Terms of Service

These Terms of Service ("Terms") govern your use of Aitune at https://aitune.uk. This website is operated by Zhihan Huang (individual operator in the People's Republic of China). "Aitune" is the service brand. By creating an account or using the service, you agree to these Terms.

1. Service

Aitune provides AI-assisted music generation, publishing tools, credit packs, and lossless download rights for your own published tracks. The service is offered globally subject to the territory restrictions in Section 2. Features may change; membership subscriptions may be marked as not yet available for purchase.

The service is operated from the People's Republic of China. Servers and third-party providers may be located outside your country. You understand that cross-border access and data processing may be subject to local laws where you access the service.

2. Territory restrictions

The service is generally available worldwide except in the Excluded Territories listed below. You must not access or use the service (including free or paid features) if you are located in, ordinarily resident in, or using the service on behalf of anyone in an Excluded Territory.

Excluded Territories (as of the last updated date above) include: Cuba; Iran; North Korea (Democratic People's Republic of Korea); Syria; Crimea, Donetsk, Kherson, Luhansk, and Zaporizhzhia regions of Ukraine; Any other country or region subject to comprehensive international sanctions; Any country or region where PayPal or our payment providers do not support the service.

We may update this list to comply with sanctions, export controls, payment-provider rules, or applicable law. The current list is part of these Terms; material changes will be reflected by updating the last updated date.

By creating an account or using the service, you represent and warrant that you are not in an Excluded Territory. If we reasonably believe you are in an Excluded Territory or have misrepresented your location, we may suspend or terminate your account without refund except where required by applicable law.

We may use reasonable measures (including payment-provider restrictions and account review) to enforce these restrictions. Such measures are not perfect; your representation remains binding.

3. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account.

4. Acceptable use

You must not use Aitune to generate or distribute content that infringes third-party rights, violates applicable law, or promotes harm. You are solely responsible for prompts, lyrics, and published works.

AI-generated outputs may not be unique and may resemble existing works. We do not guarantee that outputs are original, non-infringing, or suitable for any particular use. You must review outputs before publishing or commercial use and bear all legal responsibility for your use.

5. Generation credits and billing

Free users receive a limited number of generations per UTC day. Additional generation credits and lossless download credits may be purchased via credit packs.

When you create a generation task, one generation credit is soft-reserved. If the task completes successfully, the credit is consumed. If the task fails, the reserved credit is released and not consumed; no cash refund is issued for failed generations.

Credit packs grant generation and (for eligible packs) lossless download credits valid for twelve (12) months from purchase. Unused credits expire and are not refundable except where required by applicable law.

Referral bonus credits expire thirty (30) days after grant. Expired unused credits are not refundable except where required by applicable law.

Subscription membership purchases are not currently offered; any future subscription terms will be posted before purchase.

6. Lossless download rights

Lossless download credits apply only to your own published songs. Redeeming a credit grants licensed usage as described in our License & Usage Rights policy. Rights granted remain with you after redemption, even if other entitlements expire.

7. Third-party AI services

Music generation relies on third-party AI service providers (including music-generation APIs). Their applicable service rules and output restrictions also apply to you.

Interruptions, rate limits, policy changes, or maintenance by third-party providers may cause generation tasks to fail. When a task fails, we release the reserved credit per Section 5; we do not issue cash refunds for such failures.

We are not responsible for third-party providers' acts or omissions beyond what applicable law requires.

8. Disclaimer

The service is provided "as is" to the extent permitted by applicable law. We do not warrant uninterrupted, timely, or error-free operation.

We do not provide legal, tax, or professional advice. Nothing in the service constitutes advice on copyright clearance or commercial suitability of AI outputs.

9. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages arising from use of the service.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory law.

10. Governing law and disputes

These Terms are governed by the laws of the People's Republic of China, excluding conflict-of-law rules.

Disputes shall first be resolved through good-faith negotiation. If negotiation fails, we may bring proceedings in the competent People's Court at the Operator's domicile in the People's Republic of China. If you are a consumer, you may also bring proceedings in the courts of your country or region of residence where mandatory law grants you that right.

Nothing in these Terms limits mandatory consumer, data-protection, or other non-waivable rights under the laws of your country or region of residence.
